Terms of Service
These Terms of Service ("Terms") govern your use of VitoNode, including its hardware, software, web platform, mobile applications, and related services ("Service"). By using the Service, you agree to be bound by these Terms.
Use of the service
You may use VitoNode only in accordance with these Terms, applicable laws, and intended use. The Service is provided for monitoring, analysis, and optimization of indoor environments. You agree not to misuse the platform, attempt unauthorized access, or disrupt normal operation.
User responsibilities
You are responsible for:
• Providing accurate account and contact information
• Keeping your login credentials secure
• Ensuring that any devices registered under your account are used lawfully and appropriately
• Managing user roles and permissions if using the platform in a multi-user environment
You agree not to:
• Use the Service for unlawful, fraudulent, or abusive purposes
• Reverse-engineer or tamper with any part of the hardware or software
• Share access credentials or allow unauthorized third parties to use the Service
Intellectual property
All content, code, branding, and designs associated with VitoNode are the intellectual property of NodeByNode Systems Design UG, unless otherwise stated. You are granted a limited, non-exclusive, non-transferable license to use the software and dashboards as part of your purchased device or subscription. No ownership rights are transferred.
Limitation of liability
The Service is provided “as is” without warranty of any kind. We do not guarantee that measurements, alerts, or automation features will always function without interruption or error. To the extent permitted by law, NodeByNode Systems Design UG shall not be liable for:
• Indirect or consequential damages
These may include business interruptions, increased operational costs, or other effects not directly caused by the system, but resulting from its use.
• Loss of data or profits
For example, if sensor data is lost, becomes inaccessible, or if financial losses occur due to reliance on system recommendations.
• Misuse or misinterpretation
This includes damages resulting from incorrect understanding or improper application of sensor data or system recommendations — such as setting inappropriate threshold values, ignoring alerts, or using the system outside its intended purpose.
Account suspension and termination
We reserve the right to suspend or terminate your account if:
• You violate these Terms or any applicable law
• You attempt to compromise the integrity or security of the Service
• Your subscription is unpaid beyond the grace period
In such cases, access to data and connected functionality may be restricted or removed without prior notice.
Governing law and dispute resolution
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the competent courts in Dresden, Germany.
